Article 1 (Purpose)
The purpose of this policy is to define the responsibilities,
duties and rights of the user and cyber mall in using
the cyber mall ("mall" hereafter) services of
Internet related services ("service" hereafter)
provided by DuckSan Company (electronic service provider).
The policy is applied to electronic transactions through
PC unless the characteristics are different.
Article 2 (Definition)
* "Mall" is a hypothetical market established
to trade goods and services through information communication
facilities such as computers in order for DuckSan Company
to provide goods and services to the users, and is also
used to signify the enterprise managing the cyber mall.
* "User" indicates the members and
non-members receiving the services of the "Mall"
according to the policy by connecting to the "Mall."
* "Member" is the person that has registered
as a member by providing personal information to the
"Mall," receiving continuous information by
the "Mall," and retains the right to use the
services provided by the "Mall."
* "Non-member" is the person who uses
the services provided by the "Mall" without
gaining membership.
Article 3 (Statement and Amendment
of Policy)
* The "Mall" notifies the users on
the content, company name, office locations, name of
CEO, business registration number, contact information
(telephone, fax, e-mail, et cetera) at the primary service
screen of the "Mall."
* The "Mall" can amend this policy
within the range not violating the related laws such
as the consumer protection law, law on visit sales,
law on information communication utilization, law on
electronic signing, and elementary law on electronic
transaction.
* If the "Mall" should amend the policy,
it must notice the date of application and cause of
amendment along with the present policy at the primary
screen 7 days before the application until the day prior
to application.
* If the "Mall" should amend the policy,
the amended policy is only applied to contracts made
after the date of application and the previous policy
is applied to contracts agreed before the amendment
of the policy. However, if the users holding previous
contracts wish to be applied the amended policy, the
users can do so by sending the contract to the "Mall"
within the notification period of the amendment according
to Article 3 and receiving consent from the "Mall."
* Matters not included or mentioned in this policy
will follow related regulations, electronic transaction
consumer protection guidance established by the government
or business customs.

Article 4 (Supply of Service
and Alteration)
* The "Mall" carries out the following
business:
1. Information on goods and services, and settlement
of purchase contract
2. Delivery of goods or services on purchase
contract
3. Other businesses defined by the "Mall"
* The "Mall" can change the content
of goods and services to be provided according to the
contract to be agreed in the future in case the product
is sold out, or due to alteration in technical conditions.
In such case, the contents and supply date of the changed
goods* services should be notified and it must be notified
7 days before the date of supply in the page showing
the present goods* services.
* If the "Mall" alters the agreed content
of service to be provided to the users due to lack of
stock or technical defaults, the "Mall" compensates
for any damages done to the user. However, the "Mall"
is not responsible if it is by accident or is unintentional.
Article 5 (Suspension of
Service)
* The "Mall" can suspend its services temporarily
in case of causes such as breakdown, replacement, repair
of information communication facilities or disconnection
of communication.
* In case of service suspension due to article
1, the "Mall" notifies the users according to the methods
appointed by article 8.
* The "Mall" compensates for any damages to 3rd
parties or users occurred by temporary suspension of
services due to the causes in article 1. However, it
is not applicable if it is unintentional or accidental.
Article 6 (Membership)
* The user can apply for membership by agreeing
to the policy after inputting member information according
to the signing form stated by the "Mall."
* The "Mall" registers the applicant signing
according to Article 1 as a member unless it does not
fall under the following items: 1. If the applicant
has lost the rights to membership previously according
to Article 7 Item 3 of the policy, except for applicants
who have gained permission for membership and 3 years
have lapsed since they lost the rights to membership
previously. 2. If there is falsehood, omission of statement,
or error in entry in the registration information. 3.
If registration as another member is judged to be a
crucial technical impediment to the "Mall."
* The membership contract signing is valid at
the point where the "Mall" sends the assent to the member.
* If there is a change in the registration information
complying with Article 15 Item 1, the member is to notify
the change through e-mail or other methods to the "Mall."

Article 7 (Withdrawal of Membership
and Loss of Rights)
* A member can request for a withdrawal from
the "Mall" at any time. The "Mall"
should process the withdrawal request immediately.
* The "Mall" can limit or stop the
rights of a member in the following cases:
1. If there was falsehood in the information
input at the time of application
2. If the member does not pay the obligation
regarding the usage of the "Mall" or payment
of goods and services purchased at the "Mall"
3. If it interferes with the use of the "Mall"
of other people or threatens the electronic transaction
order such as plagiarism of information
4. If the member acts against manners or in a way that
is prohibited by the policy and regulation through the
"Mall"
* After the rights of the member are suspended
by the "Mall," the "Mall" can deprive
the rights of a member if the cause is not corrected
within 30 days or if the same action is repeated.
* The membership registration is effaced if the
"Mall" deprives the rights of the member.
In such case, the member is notified and a change is
given to revive the rights before complete effacement.
Article 8 (Notification to
Members)
* If the "Mall" notifies the member,
it can be done through the e-mail address given by the
member.
* If the "Mall" notifies an unspecified
number of general members, individual notification can
be replaced by posting a notice on the notice board
for a period exceeding one week.
Article 9 (Request for Purchase)
The user of the "Mall" can purchase a product
through the following methods:
1. Input name, address and telephone number
2. Select goods and services
3. Select method of payment
4. Indicate agreement to this policy (e.g. mouse
click)

Article 10 (Establishment
of Contract)
* The "Mall" consents to the request
for purchase according to Article 9 except for the following
cases:
1. If there is falsehood, omission of statement,
or error in entry in the registration information
2. If a teenager purchases cigarettes, alcohol
or such items that are prohibited by the teenager protection
law
3. Other cases where the "Mall" finds
crucial technical difficulty in consenting to the request
of purchase
* The contract is established at the point when
the consent of the "Mall" reaches the user in
the form of reception confirmation notification of Article
12 Item 1.
Article 11 (Method of Payment)
The payment for the goods and services purchased at
the "Mall" can be settled through one of the
following methods:
1. Wire transfer
2. Credit card
3. On-line deposit
4. Settlement through electronic currency (serviceable
in the future)
Article 12 (Receipt Confirmation
Notification)
* Purchase Request Alteration and Cancellation)
1. The "Mall" sends a receipt confirmation
notification to the user if there is a request for purchase
by the user.
2. The user can request alteration or cancellation
in the request for purchase immediately after receiving
the receipt confirmation notification if there is disagreement
in opinion.
3. The "Mall" must comply with the
request for alteration or cancellation of request for
purchase without hesitation if it is done before delivery.

Article 13 (Delivery)
The "Mall" states the method of delivery, responsibility
of delivery cost according to method, period of delivery
according to method to the user on the goods bought.
If the "Mall" exceeds the promised delivery
period on purpose or accident, the "Mall" compensates
any damage created.
Article 14 (Refund, Return
and Exchange)
* The "Mall" must immediately notify
the cause to the user if it cannot provide the services
or deliver the goods due to lack of stock on the requested
goods or services. It should carry out contract dissolution
or refund procedures within 3 days of the cause or 3
days from the day of bill received in case the payment
has been received.
* The "Mall" must immediately carry
out refund, return or exchange procedures according
to the request of the user within the next working day
from the day of receiving the goods even if it has already
been delivered in the following cases. However, the
period of request is set to be within 20 days of delivery.
1. If the delivered product is not identical
to the order or differs from the information provided
by the "Mall"
2. If the delivered product is damaged, wrecked,
or contaminated
3. If the product has been delivered later than
the declared delivery period
4. If the user subscribed in a condition where
the items to be indicated on commercial are not indicated
properly according to the law on door-to-door sales
Article 18
Article 15 (Protection on
Personal Information)
* The "Mall" collects the minimum information
required in executing the purchase contract in collecting
information from the user.
The following are mandatory items while the others are
selective.
1. Name
2. Residence registration number (in the case
of members)
3. Address
4. Telephone Number
5. Desired ID (in the case of members)
6. Password (in the case of members)
* The "Mall" must gain the consent
of the user in collecting information that can identify
the individuality of the user.
* The personal information provided cannot be
given to a 3rd party or used for other purposes without
the consent of the user, and the "Mall" is
totally responsible. The following are exceptions:
1. Notification of the minimum information of
the user (name, address, telephone number) to the delivery
company for delivery business reasons
2. Providing information for statistics, academic
research or market research, wherein the individual
cannot be identified
3. If the "Mall" needs the consent
of the user according to Article 2 and Article 3, the
regulations under Article 16 Item 3 of the law on promotion
of information communication network usage such as the
identity of the person in charge of personal information
management (position, name, telephone number and other
contact means) must be stated or announced beforehand.
Likewise, the purpose of usage and collection of information,
items related to providing information to a 3rd party
(recipient, providing purpose, and content of information
to be provided) must be stated or announced beforehand.
The user can withdraw consent at any time.
4. The user can request to view or amend errors
in personal information held by the "Mall,"
and the "Mall" has the responsibility to execute
the necessary procedures without hesitation. In case
the user requests to amend errors, the "Mall"
may not use the personal information until the error
is amended.
5. The "Mall" restricts managers for
the purpose of protecting personal information to the
least, and holds responsibility for the loss, theft,
outflow, forgery of personal information of users including
credit card, bank account, et cetera.
6. The 3rd party that has received personal information
from the "Mall" is to destroy the personal
information without hesitation as soon as the purpose
of collection or offer is achieved.

Article 16 (Duty
of the "Mall")
* The "Mall" does not act against this
policy or public customs, and strives to provide the goods
and services continuously and in a stable manner according
to the policy.
* The "Mall" must be equipped with security
systems to protect the personal information (including
credit information) to guarantee a safe Internet service
to users.
* According to the "Law on Equality of Indication
* advertisement," the "Mall" is responsible
for damages to the user caused by unjust indication *
advertisement.
* The "Mall" does not send out unwanted
e-mails with the purpose of profit.
Article 17 (Obligation on
Membership ID and Password)
* With the exception of Article 15, the member
is responsible for the ID and password.
* The member cannot allow a 3rd party to use
their ID and password.
* The member must notify the "Mall"
as soon as recognizing the loss of their ID and password
or if a 3rd party is using it. The member must follow
the instructions of the "Mall."
Article 18 (Obligation of
the User)
Users are prohibited from the following:
1. Registration of false information in application
or amendment
2. Alteration of information notified by the
"Mall"
3. Transmission or notification of information
(such as computer program) other than those declared
by the "Mall"
4. Violation of intellectual rights such as copyright
of 3rd party
5. Interference of business or damage to reputation
to 3rd party
6. Notification or disclosure of violent or improper
message, image, audio opposing to public customs

Article 19 (Relationship
between Connecting "Mall" and Connected "Mall")
* If the upper "Mall" and lower "Mall"
is connected through hyperlink (e.g. the object of hyperlink
includes letters, pictures and images), the former is
called the connecting "Mall"(website) and the
later is called the connected "Mall"(website).
* The connecting "Mall" is not responsible
for guarantee of trade on the goods and services provided
independently by the connected mall if such intentions
are stated in the connecting "Mall" site.
Article 20 (Possession of
Copyright and Restrictions on Usage)
* The "Mall" possesses the copyright
and intellectual rights on the writings by the "Mall."
* The user cannot use, copy, transmit, publish,
distribute, broadcast or use any information attained
from the "Mall" through other methods for
profit purposes or apply to 3rd parties without prior
consent of the "Mall."
Article 21 (Resolution of
Disagreement)
* The "Mall" establishes and operates
a damage compensation board to compensate damages, and
to project complaint and fair opinions aroused by the
user.
* The "Mall" gives top priority to
complaints and opinions aroused by the user. However,
the user is notified of the cause and process schedule
immediately if a prompt process is impossible.
* Dispute between the "Mall" and user
can refer to arbitration of the electronic transaction
dispute arbitration committee established under Article
15 and Article 28 of the Elementary Law on Electronic
Transaction.
Article 22 (Jurisdiction and
Reference)
* Lawsuits regarding disputes between the "Mall"
and user are submitted to the district court of civil
law suit.
* Korean law is applied to electronic transaction lawsuit
aroused by the "Mall" and user.
